1. Provider and scope
These Terms cover Human to Dog Translator: Play for iPhone (the App) and humantodogtranslator.app (the Website). The provider is Vladyslav Yepishkin, an individual developer, referred to as "we", "us" or "our".
Postal address: Tirdi tn 8, Apt 40, Tallinn, Harju maakond, 10916, Estonia.
Contact: support@humantodogtranslator.app.
By using the services, you agree to these Terms to the extent an agreement can validly be formed under applicable law. If you do not agree, do not use the services. Nothing here removes rights that cannot lawfully be excluded.
2. Who may use the services
The App and Website are intended for adult dog owners and teenagers aged 13 or older. They are not directed to children under 13. A higher minimum age or additional parental authorisation required by local law takes precedence.
If you are below the age of majority, you may use the services only with a parent's or legal guardian's permission and supervision, where permitted by law. That adult should review these Terms with you. Purchases must be authorised by the Apple Account holder and any parent or guardian whose authorisation is required.
These eligibility conditions do not replace Apple's age rating, parental controls or applicable children's privacy law.
3. What the App does
The App provides entertainment experiences using locally processed audio, playful result phrases, synthetic sounds, games and tone controls. Features and free-use limits are shown in the App; some features require a paid subscription.
The App does not provide a scientifically validated translation of animal language. Its phrases, sound patterns and mood labels do not establish what a dog thinks, feels or intends, and do not guarantee that a dog will respond.
The App is not veterinary advice, diagnosis, an animal-safety system or a substitute for professional training. For concerns about your dog's health or behaviour, consult an appropriately qualified professional.
4. Apple licence and these additional terms
The App licence is governed by Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA). These Terms provide additional information about our services and their use; they are not a replacement custom EULA.
For the App's software licence, the Apple Standard EULA governs if these additional Terms conflict with it, subject always to mandatory applicable law. Apple's purchase terms and usage rules also apply to App Store transactions.
Our name, App content and other materials are protected by the rights of their respective owners. Apple, third-party software, fonts and other licensed materials retain their owners' rights and applicable licence terms. Nothing here transfers those rights to you or to us.
5. Device permissions, local content and sharing
Recording features require microphone permission. A profile photo is optional and selected through the system photo picker. Information about local storage, temporary recordings and support is in the Privacy Policy.
You retain any rights you have in the photos, recordings and other material you choose to use. These Terms do not grant us a right to publish or commercially exploit your locally stored material. Use only material you are entitled to use and respect other people's privacy.
The App does not operate a user-account service, public feed or content-hosting platform. Sharing sends result text through the system share sheet to the destination you choose. Review the recipient and content before sending; that external service's terms apply.
Protect your device and any backups. App data or functionality may be affected by device failure, removal of the App or operating-system changes; this does not limit remedies required by law.
6. Safe use
Start at a low, comfortable volume, keep the speaker away from sensitive ears and stop if your dog appears uncomfortable. Supervise interactions and do not use sounds to frighten, harass or harm an animal.
Do not rely on a result to decide whether an animal is safe to approach, whether it is in pain, or whether professional care is needed. You remain responsible for the animal's welfare and appropriate handling.
7. Free features and optional subscriptions
The App offers limited free use and optional auto-renewable Premium subscriptions. The purchase screen identifies the included paid features, available plan, billing period and local price before you confirm a purchase. The catalogue may include monthly and yearly plans; availability and offers depend on the App Store storefront.
Apple processes the purchase and charges the Apple Account associated with it according to the terms shown at confirmation. We do not take payment-card details directly.
A subscription renews automatically for the selected billing period unless cancelled before renewal according to Apple's subscription settings. Review the renewal date and current price shown by Apple. Changes to subscription prices or terms are handled subject to Apple's procedures and applicable law, including notice or consent where required.
No free trial or introductory discount is promised by these Terms. If Apple specifically offers one, its duration, eligibility, subsequent price and renewal terms must be shown before confirmation.
Cancelling and managing a subscription
On iPhone, open Settings, select your Apple Account, then Subscriptions and choose the subscription to manage or cancel it. See Apple's cancellation instructions for the current process.
Cancel sufficiently in advance of renewal. If you accept a free or discounted trial and do not want it to renew, Apple advises cancelling at least 24 hours before it ends. Access after cancellation follows the expiry information shown by Apple and the applicable offer terms.
Deleting the App, resetting local data or emailing support does not by itself cancel your Apple subscription.
Restoring purchases
Use Restore Purchases in the App while signed into the Apple Account used for the purchase. Restoration depends on a valid entitlement recognised by Apple; it does not create a new purchase or extend an expired subscription.
Refunds and consumer rights
You can request a refund from Apple for an App Store purchase. Eligibility and processing follow Apple's rules and applicable law. We cannot guarantee approval of a refund request.
You may also contact us about a problem with the App. Nothing in these Terms removes a right to a remedy, refund, cancellation or withdrawal that applies under mandatory consumer law.
8. Acceptable use
Use the App and Website lawfully and within the applicable licence. Do not interfere with their security, attempt unauthorised access to another person's information, misuse support channels, infringe another person's rights, or use the sounds or other features to cause harm.
Restrictions on copying, modification or reverse engineering are subject to the Apple Standard EULA, applicable third-party licences and any activity that applicable law expressly permits. These Terms do not prohibit a non-waivable legal right.
9. Updates and availability
We may release updates to improve, secure or change the services. Device and iOS compatibility requirements are stated in the App Store listing. Some services, including purchases, restoration, the Website and support, need a working internet connection; your network provider's usual charges may apply.
Material changes affecting paid access will be handled with the notice and remedies required by applicable law and Apple's purchase terms. We will not use a general right to change the App to remove mandatory rights associated with an existing paid subscription.
If a service must be discontinued, we will provide reasonable advance notice where practicable and required by law, and respect applicable rights concerning already-paid access. Ending the software licence remains subject to the Apple Standard EULA.
10. Responsibility and mandatory protections
The entertainment limitations in section 3 describe the product's purpose. They do not exclude responsibility for delivering the paid features as described or for meeting obligations imposed by law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.
Your statutory consumer rights remain in force. These Terms do not impose a blanket obligation on consumers to reimburse our legal costs or give us an unrestricted right to retain payments for services we do not provide.
11. Privacy and external services
The Privacy Policy explains how App, Website and support information is handled. Agreeing to these Terms does not constitute consent to optional analytics or waive privacy rights.
External services such as Apple, your email provider and a destination you choose for sharing have their own terms. Their availability is outside our direct control, without affecting any responsibility that applicable law places on us.
12. Applicable law, complaints and changes
Applicable law and the competent courts are determined by the Apple Standard EULA for the App licence and by the mandatory rules that apply to the particular service or dispute. These Terms do not require you to waive protections or a right to bring a claim in a court available under mandatory consumer law.
Please send service complaints to support@humantodogtranslator.app, or write to Vladyslav Yepishkin at the postal address in section 1. Contacting us first is not a condition of exercising a statutory complaint or court remedy.
We may update these Terms and will show the new revision date. Material changes will be communicated and, where legally necessary, accepted before they take effect for you. An update does not retroactively remove a right relating to an earlier purchase.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These additional Terms must be read together with the Apple Standard EULA, applicable purchase terms and mandatory law.
